PBS chief fears Beshear’s grounds
Dir Steve Beshear’s a new search request to choose a leading provider of higher education’s Kentucky was without Friday.
John Turner, president of the Council of State in Post Secondary Education, said it would be “premature” to say, as the Council to respond to Beshear.
“The first step is for me to receive and see the Governor and see exactly what are its goals,” said Turner.
Beshear has made the order Thursday after Attorney General Jack Conway explained that the Council has recently recruiting Lexington lawyer Brad Cowgill was illegal.
Although Beshear and Turner said Friday it hoped the dispute amicably, in a Turner speculate April 21 letter to Council members that the governor may have political reasons for the investigation Cowgill’s parameter .
“I wonder if it is possible that the true priority of the governor of attention, we’re not Brad,” he wrote, and pointed out that removal of the Beshear Council resolution “to accelerate the point ( a few years) if the Council Beshear especially by the governor of humans. ”
Cowgill, the budget for the ex-director of Dir Ernie Fletcher, before the latter by the Interim President of September, has been leased long-term earlier this month.
The Attorney General’s opinion unsaid, the Council was obliged by law, a national research before renting a president.
Turner explained in his letter he did not know what the Attorney General opinion, but I speculate on its (sic) more than likely he may not agree with the statements by the governor.
“I think the governor would be quite confident that the outcome before the AG opinion, if there are few benefits of the application.”
He said Beshear or Conway, an appeal to the court and obtain a binding decision.
“This is a chance, in our opinion, the courts,” said Turner, but “another side to this idea, they can eat some time.”
Another option for Beshear, Turner said, it is necessary to ask for the resignations of Council members.
“If we resigned, so the governor to appoint a new collection of Council members, the election of a permanent president anyway they want,” said Turner. “Any Council action on the part along this line would, in my judgement, for a total of renouncing our independence.”
Beshear “could only try, in the town resolution as a whole,” said Turner.
“I do not know what the question whether the governor has the legal authority to do so,” said Turner. “I would say that this type of measure would obviously interests of the General Assembly, because the legislature, the Board of an independent agency To give some gubernatorial isolation of the policy.”
